A recent Slate.com post cites Wedlocked, an article written by Mary Patricia Byrn & Morgan L. Holcomb and published in Volume 67, Issue 1 of the University of Miami Law Review, for its insightful take on same-sex divorce. The Slate article, written by Dahlia Lithwick & Sonja West, addresses yet another chapter in the ongoing struggle of same-sex couples to divorce in states that do not legally recognize same-sex marriages. On November 9th, the Supreme Court of Texas will hear arguments on the constitutionality of denying divorces to same-sex couples. Wedlocked opines that this denial violates the “due process trinity”: the right of access to courts (to obtain a divorce); the right to divorce; and the right to marry someone else. Lithwick & West happen to agree, and they approve of Wedlocked while concluding that denying same-sex divorce is not only unlawful, but also undignified.
